Terms of Service
These terms of service ("Terms") govern your use of the services provided by Deck AI ("Deck AI" or "we") through the website located at deckai.app (the "Website") and the Deck AI mobile app (the "App", and together with the Website, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not permitted to use the Services.
1. Description of Service
Deck AI provides analysis, creation, and improvement tools for Clash Royale decks through the Website and the App. We offer an optional subscription that users can sign up for to gain access to additional tools and features across the Services. Free users have limited access to the Services, while subscribers enjoy enhanced features and benefits.
2. Subscription Terms
Deck AI Premium is offered under a subscription model. Users can use discount codes provided by Deck AI or partnered creators to receive a discount on their first purchase. Billing is processed immediately upon purchase and then continues indefinitely during each billing period based on the plan chosen by the user until the user cancels their subscription. Payment processing and management is provided by our third-party payment processor. Users have the right to cancel their subscription at any time. Subscribers will have access to the premium features until the end of their current billing cycle, after which they will not be charged unless they choose to resubscribe.
3. User Obligations
To use our services, users must agree to the conditions stated in the Terms and privacy policy.
4. User Accounts and Access
Upon creating an account, users are responsible for maintaining the confidentiality of their account information. Account sharing (the use of a single account by multiple individuals) is prohibited and may result in account termination.
5. Modification of Services
Deck AI reserves the right to modify or discontinue services at any time without notice or compensation. Changes to subscription prices will be communicated via company email to the user's registered email address.
6. Intellectual Property
Deck AI Technologies, Inc. owns all intellectual property rights to the content and materials provided through the Services. Users are granted the right to use the Services in accordance with these Terms.
7. Privacy and Data Protection
Please refer to our privacy policy for information regarding the collection, storage, and handling of user data. We collect personal information from users, including contact information, profile information, usage information, and device information. We use this information to provide our services, improve the Services, respond to inquiries and support requests, monitor and analyze usage, and communicate with our users. We do not share user information with third parties, except with service providers necessary for providing our services and in compliance with legal requirements.
8. Limitations of Liability
To the fullest extent permitted by law, Deck AI Technologies, Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages. Users agree to indemnify and hold harmless Deck AI Technologies, Inc., its affiliates, officers, directors, employees, agents, and partners from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with their use of the Services, violation of the Terms, or infringement of any third-party rights.
9. Account Termination
Deck AI reserves the right to terminate or suspend user accounts at any time and for any reason. We may also modify or discontinue our services without prior notice. All sales are final, and no refunds will be provided.
10. Dispute Resolution
The formation, interpretation, and performance of these Terms and any disputes arising out of it shall be governed by the substantive and procedural laws of Maryland, United States, without regard to its rules on conflicts or choice of law. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Maryland, United States, and users hereby submit to the personal jurisdiction of such courts. Users waive any right to a jury trial in any proceeding arising out of or related to these Terms.
11. Creator Program
Deck AI operates a Creator Program that allows eligible users to earn money by creating and promoting Clash Royale content featuring Deck AI. Participation in the Creator Program is entirely optional and requires a separate application and acceptance of the Creator Program Terms of Service during onboarding. The Creator Program Terms govern all aspects of creator participation including content submissions, earnings, payouts, tier progression, and account linking. In the event of a conflict between these general Terms and the Creator Program Terms, the Creator Program Terms shall prevail for matters related to creator participation. 12. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between the user and Deck AI Technologies, Inc. regarding the use of the Services.
